This is a review of an unpublished decision of the court of appeals modifying, and affirming as modified, the judgment of the circuit court for Outagamie county. The primary issue presented on review is the propriety of an award of punitive damages without a showing of actual malice on a finding of fraudulent misrepresentation in the inducement to enter a contract. Also challenged is the sufficiency of the evidence to support the jury's finding of fraudulent misrepresentation. We conclude that punitive damages were properly awarded based on the facts of this case. We also conclude the jury was warranted in finding fraudulent misrepresentation.
